Understanding Legal Aid in Family Law with Amicus Law

Legal issues within families can be highly stressful, and navigating the legal system can feel overwhelming. Fortunately, legal aid is available for those who qualify, helping to ensure that individuals have access to expert legal support regardless of their financial situation. At Amicus Law, we are dedicated to providing clarity and guidance on family legal aid, helping you understand your rights and available options.

Types of Family Legal Aid

Family legal aid is divided into two main types:

  • Legal Help (Controlled Work): This covers general advice and assistance but does not include court representation.
  • Legal Aid with a Public Funding Certificate: This provides representation in court proceedings if eligible.

Private Law Legal Aid

Private law cases involve disputes between individuals, including:

  • Divorce and financial relief cases
  • Non-molestation orders (injunctions)
  • Children Act proceedings (e.g., residence and contact disputes)

Legal Help is available for initial advice and assistance, but individuals must meet financial eligibility criteria and provide evidence of domestic abuse or significant harm to qualify.

For full legal aid (a public funding certificate) in non-molestation order applications, eligibility is based on financial circumstances. Those receiving certain benefits (e.g. Universal Credit) are generally eligible without needing to provide evidence of abuse. However, for financial relief or Children Act cases, proof of domestic abuse or child harm is required, typically obtained from a GP, domestic violence support worker, or local authority.

Public Law Legal Aid

Public law cases involve disputes between individuals and local authorities, such as Somerset or Dorset Council. Legal Help is available to parents who receive a Public Law Outline (PLO) letter, inviting them to a meeting about child welfare concerns. This legal aid is non-means and non-merits tested, meaning everyone qualifies regardless of income.

If care proceedings or emergency protection orders are initiated, full legal aid is granted automatically, as these cases can lead to the separation of families. Our legal team can complete and submit the necessary applications without requiring financial assessments or additional evidence.
