Frequently Asked Questions
Whether you are buying a home, planning your estate, or arranging a Lasting Power of Attorney, it is natural to have questions. Our Seaton team has put together answers to some of the things we are most commonly asked — from what happens if you lose mental capacity without an LPA in place, to how probate works and whether you need a solicitor to write your will.
If your question is not covered below, or you would simply prefer to speak with someone directly, our Seaton office is always happy to help. You can call us, drop us an email, or fill in our contact form and a member of the team will get back to you as soon as possible.
What happens if I lose mental capacity without a Lasting Power of Attorney?
Without an LPA in place, even your closest family members have no automatic legal authority to manage your finances or make decisions about your care. An application to the Court of Protection would be needed, which can be a lengthy and expensive process. Putting an LPA in place now avoids this entirely and gives you and your family genuine peace of mind.
Do I need a solicitor to write a will?
While it is possible to write a will yourself, using a solicitor ensures your wishes are expressed clearly and legally, with no risk of the document being challenged or failing to achieve what you intended. This is particularly important where your estate involves property, trusts or complex family circumstances.
How long does probate take?
Probate can take anywhere from a few months to over a year depending on the complexity of the estate. Our Seaton team will guide you through every step and keep things moving as efficiently as possible, keeping you informed throughout.
What is the difference between a Property and Financial Affairs LPA and a Health and Welfare LPA?
A Property and Financial Affairs LPA authorises your chosen attorney to manage your bank accounts, bills and property on your behalf. A Health and Welfare LPA authorises them to make decisions about your care and medical treatment. Most people benefit from having both in place and our team will advise you on which is right for your situation.
Can you help with conveyancing for coastal and rural properties in East Devon?
Yes. Our Seaton team is experienced in acting on a wide range of property transactions along the Devon and Dorset coast, including coastal properties, rural homes and those with particular title or access considerations. We provide the same clear and personal service whatever the complexity of the transaction.
