The incident occurred when the client was delivering goods to a business premises. Upon entering the site, he unknowingly stepped into an unlit inspection pit, which had no warning signs or barriers to alert him to the danger.
Incident Details
The inspection pit was poorly lit and lacked any signage, making it an unseen hazard. As a result of the fall, Erin’s client sustained serious dental injuries and soft tissue damage. These injuries not only caused significant pain but also required time off work to recover, impacting both his physical wellbeing and income.
Legal Argument
Erin pursued the claim under the Occupiers’ Liability Act 1957, arguing that the Defendant had failed in their duty of care to ensure lawful visitors were safe while on the premises. Initially, the Defendant denied liability, claiming the area was cordoned off with a chain and implying the client had ignored this barrier. Erin’s client strongly disputed this, maintaining that no such chain was present at the time of the accident.
Outcome
The Defendant was ultimately unable to provide any evidence that a chain was in place. Faced with this lack of proof, they admitted liability. Erin successfully negotiated a five-figure settlement, bringing the matter to a positive conclusion and enabling her client to move on from a distressing experience
