Case Study: Five figure settlement for injured fast-food worker

Background

Erin, a Chartered Legal Executive in our Personal Injury team, recently secured a five-figure settlement for a fast-food worker who was injured at work while carrying out a task he was not trained to do. 

Incident Details

He had been asked by his manager to create a temporary fix to a piece of machinery that had broken and put a halt on food service. This was a job that he should not have been asked to do as he had not been trained to fix machinery and it was not a part of his job description. He attempted to carry out the repair and slipped with the screwdriver, puncturing his finger. His employer failed to provide him with any first aid and he was mocked for complaining about the injury. The injury progressed into an infection from his finger up to his armpit which required an admission to hospital and 3 surgeries to clear out.

Legal Argument

Erin pursued the claim raising allegations that the employer had breached the Management of Health and Safety at Work Regulations 1999 by failing to appropriately risk assess and that they had failed to administer first aid, resulting in the injuries the client suffered.

Outcome

The Defendant denied liability for the accident, stating that it was the client’s fault for not seeking first aid. Erin argued that the employer was aware of the accident and that first aid should have been offered as soon as they had been made aware of the accident.  Liability was never admitted by the Defendant, yet Erin obtained a five-figure settlement for her client, bringing the matter to a positive conclusion and enabling her client to move on from a distressing experience.
