Erin, a Chartered Legal Executive in our Personal Injury team, recently secured a large settlement for a carpenter who was injured at work when his hand was pulled into the machine he was using.
Incident Details
Erin’s client had been using a tilting spindle moulder. Unfortunately, his employer had failed to maintain the machine. The machine was defective, and pulled the client’s hand into it. He suffered a partial amputation of his index finger, as well as lacerations to his other fingers, meaning he could no longer safely use a drill or a saw, tools he uses every day for his work. He also suffered from post-traumatic stress disorder as a result of the accident.
Legal Argument
Erin pursued the claim raising allegations that the employer had breached the Management of Health and Safety at Work Regulations 1999. The Defendant admitted liability, agreeing that they had breached their duty of care to Erin’s client.
Outcome
Erin was able to secure compensation for her client, including an amount for his physical and mental injuries and the disadvantage he would likely suffer on the labour market in the future.
