Understanding no-fault divorce in the UK
Since April 2022, UK law introduced no-fault divorce, removing the need to assign blame. To start, you must confirm the marriage has “irretrievably broken down.” Applications can be made online, either jointly or individually. After the court issues your application, a 20-week reflection period begins before you can apply for a Conditional Order. Six weeks later, you may apply for the Final Order, which legally ends the marriage. However, financial matters are separate and require a court-approved financial order.

Can I get divorced without the other persons knowing about it or if they do not give consent?
Yes, you can. A divorce application does not need the permission of the other person but quite often it is best practice to tell them you are starting the process. We can discuss this with you and help you decide the best approach for you.
How much does it cost to get divorced?
The court fee is £612 and the person making the application must pay that fee (unless you can apply for a means tested exemption). You cannot claim the fee back from the other person.

What happens if I don’t know where the other person lives or one of us does not live in the UK?
It is important that you talk to us as soon as you can. It may be important to get the divorce started in this jurisdiction as soon as possible.
How long does a divorce take?
After the court have issued the application there is a period of at least 26 weeks before you can be legally divorced. However, this is the minimum time and often the Conditional Order and the Final Order need to be delayed to ensure the financial matters are resolved.
