Protecting your financial future after divorce

Finalising your divorce does not automatically resolve financial matters. To legally divide assets, a court order is required. Whether you reach an agreement amicably or need court intervention, it’s vital to seek legal advice. A consent order can formalise agreements, while unresolved disputes may require a financial remedy application. Every case is unique – factors like income, property, pensions, and children’s needs all play a role. Leaving financial matters unresolved can carry long-term risks. Our experienced team will guide you through the process, ensuring your interests are protected and your future is secure.

Key financial considerations in divorce

Every divorce is unique. These are some of the key financial factors the court may consider when dividing assets and determining future financial arrangements.

  • Do either of you have any disability that may effect how assets are divided.
  • How will the needs of each person and the children be met – this includes where you will live and how your monthly expenses will be paid. A key factor considered by the court is meeting needs.
  • What income do you each have now and in the future.
  • Should one person pay the other spousal maintenance each month or should there be a clean break.
  • Whether one person can stay living in the house and whether they need to give a share of the equity to the other person.
  • How will the mortgage on your house be paid?
  • Are there any pensions, and if so, will there need to be a pension share or can it be offset with other money.
  • Can you keep your inheritance.
  • Can you keep the house you owned before you met your spouse.
  • Can you keep the money a family member gifted to you.
