Understanding family legal aid

Family legal aid helps cover the cost of legal advice and representation in family law cases. There are two main types:

Legal Help (controlled work), which offers preliminary advice and assistance, and,
Legal Aid under a public funding certificate, which covers court representation.

Private law cases include divorce, financial relief, injunctions, and child arrangements, often requiring evidence of domestic abuse or risk of harm. Public law cases involve disputes with local authorities, such as care proceedings, where legal aid is usually non-means tested. Eligibility depends on financial criteria and case merits, ensuring access to justice for those in need.

How legal help works

Legal Help provides early advice before court proceedings. It includes assessing financial eligibility and case merits. For private law, evidence of domestic abuse or child harm is often required. For public law, parents invited to a PLO meeting automatically qualify.

Answers to common questions about eligibility, evidence, and the application process for family legal aid in private and public law cases.

What is Legal Help?

Legal Help offers initial advice and assistance before court proceedings. It does not cover representation but helps assess eligibility for full legal aid.

Do I need evidence of domestic abuse?

Yes, for most private law cases like child arrangements or financial relief, evidence from a GP, police, or DV support worker is required.

Is legal aid means-tested for care proceedings?

No. In public law cases like care proceedings, legal aid is non-means and non-merits tested. All parents and those with parental responsibility qualify.
